IMPORTANT: BY SUBMITTING YOUR INFORMATION, CALLING OUR NUMBER, OR TEXTING US, YOU AGREE TO THESE TERMS AND OUR SMS COMMUNICATIONS POLICY. PLEASE READ CAREFULLY.
1. ACCEPTANCE OF TERMS
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Birddog Investment Group, LLC, a South Carolina limited liability company operating as Birddog Home Buyers, Birddog Seller Services, and RealBids.co (“Company,” “we,” “us,” or “our”). By accessing our websites, submitting a form, calling or texting our phone numbers, or otherwise engaging with our services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our websites or services. Your continued use of our websites or services after any modification to these Terms constitutes your acceptance of the modified Terms.
2. DESCRIPTION OF SERVICES
Birddog Investment Group, LLC provides real estate acquisition, disposition, wholesale, novation, and auction brokerage services in South Carolina and Georgia. Services may include, but are not limited to:
- Cash purchase offers for residential and commercial real estate
- Wholesale assignment transactions
- Novation agreements and retail MLS listing services
- Online real estate auction services through RealBids.co
- Real estate consultation and lead generation services
Ryan Birddog is a licensed real estate agent in Georgia (Bluefield Realty Group) and a licensed auctioneer. Services involving licensed real estate activity are conducted in compliance with applicable state law.
3. SMS / TEXT MESSAGE COMMUNICATIONS — A2P 10DLC COMPLIANCE
3.1 Consent to Receive Text Messages
By providing your mobile telephone number to Birddog Investment Group, LLC — whether by submitting a web form, calling us, texting us, verbally providing it to a representative, or any other means — you expressly consent to receive recurring automated and manually dialed SMS and MMS text messages from or on behalf of Birddog Investment Group, LLC at the mobile number you provided.
These messages may include:
- Responses to your inquiries about selling your property
- Property offers, counter-offers, and transaction updates
- Appointment reminders and scheduling communications
- Auction registration confirmations, bidding alerts, and results
- Follow-up communications regarding your property or transaction
- Informational messages about our services
- Marketing and promotional content related to real estate services
You acknowledge that consent to receive text messages is NOT a condition of purchasing any goods or services from us.
3.2 TCPA Notice — Automated Messaging
TCPA DISCLOSURE: By providing your phone number and consenting to our communications, you expressly authorize us to contact you using an automatic telephone dialing system (ATDS), artificial or prerecorded voice, and automated SMS text messages, even if your phone number is on a state or federal Do Not Call Registry. Standard message and data rates may apply.
This consent applies to the mobile number provided and covers communications initiated by Birddog Investment Group, LLC and its authorized agents, vendors, or representatives acting on our behalf.
3.3 Message Frequency
Message frequency varies based on your transaction status and engagement. You may receive up to [10] messages per month related to your inquiry, transaction, or follow-up. Transactional messages (offers, appointment confirmations, etc.) are not limited by marketing frequency caps but will not exceed what is reasonably necessary for your transaction.
3.4 Message and Data Rates
Standard message and data rates may apply to all SMS and MMS messages sent to or received from Birddog Investment Group, LLC. These charges are assessed by your mobile carrier and are your responsibility. Birddog Investment Group, LLC does not charge separately for SMS communications.
3.5 How to Opt Out
You may opt out of receiving text messages from Birddog Investment Group, LLC at any time by:
- Texting STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message received from us
- Emailing your opt-out request to info@birddoghomebuyers.com with your name and phone number
- Calling us at [INSERT PHONE NUMBER] and requesting removal
After texting STOP, you will receive a single confirmation message acknowledging your opt-out. Following that, you will receive no further marketing messages. You may still receive transactional messages necessary to complete an existing transaction, unless you request complete cessation of all communications.
To re-subscribe after opting out, text START, YES, or UNSTOP to any of our numbers, or re-submit your information through our website.
3.6 Help

3.7 Supported Carriers
Our SMS services are supported by most major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Metro PCS, U.S. Cellular, and others. Carrier availability may vary. Birddog Investment Group, LLC is not liable for delays or failures in message delivery caused by your carrier.
3.8 A2P 10DLC Registration
Birddog Investment Group, LLC’s text message campaigns are registered with The Campaign Registry (TCR) under the A2P 10DLC (Application-to-Person, 10-Digit Long Code) framework as required by major U.S. carriers and the CTIA. Our messaging campaigns comply with all applicable CTIA Messaging Principles and Best Practices, carrier guidelines, and federal regulations including the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227.
3.9 Prohibited Uses
You agree not to use our SMS services to send unsolicited messages to others or misuse our contact information. You represent that the phone number you provided is your own and that you are authorized to consent to receive messages at that number.
4. TELEPHONE CONSUMER PROTECTION ACT (TCPA) COMPLIANCE
Birddog Investment Group, LLC complies with the Telephone Consumer Protection Act, 47 U.S.C. § 227, and its implementing regulations at 47 C.F.R. Part 64. Specifically:
- We obtain prior express written consent before sending marketing or promotional text messages using an ATDS or prerecorded voice
- We maintain an internal Do Not Call (DNC) list and honor opt-out requests within 10 business days
- We honor the National Do Not Call Registry for telemarketing calls, subject to applicable exemptions
- We identify ourselves in all calls and messages
- We do not make calls or send messages to residential lines before 8:00 a.m. or after 9:00 p.m. local time of the recipient
- We train our staff on TCPA compliance requirements

5. CAN-SPAM ACT COMPLIANCE
All commercial email communications from Birddog Investment Group, LLC comply with the CAN-SPAM Act, 15 U.S.C. §§ 7701–7713. Each commercial email will:
- Clearly identify the sender and include our physical mailing address
- Include a clear and conspicuous opt-out mechanism
- Process opt-out requests within 10 business days
- Accurately identify the subject matter of the email
- Not use deceptive headers or subject lines
6. USER ELIGIBILITY
By using our services, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal authority to enter into these Terms; (c) if acting on behalf of a legal entity, you are authorized to bind that entity; and (d) your use of our services does not violate any applicable law or regulation.
7. REAL ESTATE SERVICES DISCLOSURES
7.1 Not Legal or Financial Advice
Nothing in our communications, website content, or interactions constitutes legal, financial, investment, or tax advice. You should consult with a qualified attorney, financial advisor, or tax professional before making any real estate decision.
7.2 Licensed Activity Disclosure
Ryan [Last Name] is a licensed real estate agent in the State of Georgia, affiliated with Bluefield Realty Group (Broker-in-Charge: Ashley Eller). In South Carolina, Birddog Investment Group, LLC operates as a real estate wholesaler and auctioneer. Applicable agency disclosures will be provided at the time of any transaction requiring a licensed real estate agent.
7.3 Cash Offers
Any cash offers made by Birddog Investment Group, LLC are preliminary estimates and not binding until memorialized in a written purchase agreement signed by authorized representatives. Offers are subject to inspection, title review, and due diligence.
8. INTELLECTUAL PROPERTY
All content on our websites — including text, graphics, logos, images, and software — is the property of Birddog Investment Group, LLC or its licensors and is protected by applicable U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. DISCLAIMER OF WARRANTIES
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, BIRDDOG INVESTMENT GROUP, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Birddog Investment Group, LLC and its members, managers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your violation of these Terms; (b) your use of our services; (c) your violation of any third-party rights; or (d) any inaccuracy in information you provide to us.
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or our services shall first be submitted to informal negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Greenville County, South Carolina. Each party shall bear its own attorneys’ fees unless the arbitrator finds bad faith.
12.3 Class Action Waiver
YOU AND BIRDDOG INVESTMENT GROUP, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the revised Terms on our website with an updated effective date, and may also notify you via email or SMS. Your continued use of our services after such notification constitutes acceptance of the revised Terms.
